Construction Litigation

Cumming Construction Litigation Attorneys

Due to the large scale of most construction projects, their generally long duration and the involvement of several different entities, including the general contractor, a variety of sub-contractors, the government and the architect, disputes are inevitable and expected.

At the Hamilton Law Firm, our skilled attorneys will relentlessly pursue a fair outcome of civil law disputes related to construction, whether through persuading dispute boards, arbitrators or the court.

Buford Construction Law Lawyers

The practice of construction law encompasses lawsuits filed by homeowners against their contractors and sub-contractors for inadequate building materials or shoddy construction, to corporate owners filing lawsuits for breach of contract against the general contractor of large-scale industrial complexes.

Both of our founding partners, Frank and James Hamilton, were in the construction business for several years prior to practicing law. As a result, they understand the business and have great relationships with industry experts — crucial to the success of a construction lawsuit.

Since founding the Hamilton Law Firm, Frank and James have handled several large construction litigations. We represent builders, sub-contractors, architects and homeowners in the full range of construction disputes.

Construction Dispute Boards and Arbitration

Many contracts governing large construction projects include a dispute resolution provision which will outline the dispute resolution process. Oftentimes, especially in the case of large construction projects that will span several years, these provisions provide for the creation of dispute boards.

Dispute boards are composed of independent and impartial parties selected by the parties at the beginning of the project before any disputes occur, who are actively involved in the construction project throughout. Although their determinations are not binding, their advice is respected because they have been involved from the beginning. This process allows the project to continue without costly interruptions and delays.

Where a construction project's contract does not provide for dispute boards or where one or more of the involved parties does not agree with the board's findings, the dispute will often go to litigation or possibly to arbitration, where the governing contract so provides.

Our attorneys are able to assist you with disputes arising in construction projects from start to finish, including advising on whether to accept the dispute board's resolution or to go forward in litigation or arbitration, where relevant. We will then zealously and relentlessly represent your interests in court.
